1. Who we are
Droppin (the "Service") is operated by Summit Esports LLC, a California limited liability company doing business as Droppin ("we", "us"). Reach us at legal@wherewedroppin.com.
2. Accepting these terms
By using the Service (including making an account, signing in with your email or Discord, or buying Pro Unlock) you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
3. Eligibility
Droppin is for players 13 and up: you must be at least 13 years old to make an account and use the Service. If you are under 18, you may use the Service only with the involvement of a parent or guardian, and only a parent or guardian may buy a subscription. We do not knowingly collect personal information from children under 13; if we learn that we have, we will delete it.
4. Your account
You make an account with your email address, a username and a password, or by signing in with Discord. One account per person, with an email address you can receive mail at. Keep your password private: you are responsible for activity under your account. Usernames must not impersonate anyone or be offensive; we may change or remove ones that are. You can delete your account at any time from your account page, and we may suspend or close accounts that break these terms.
5. What the service is
The Service is an unofficial planning tool. It shows a map, lets you set a bus route and a landing spot, and calculates a suggested jump point, jump timing and descent from a physics model fitted to recorded gameplay. It does not connect to, read from, or modify any game, game client, account or server, and it provides no automation, input or advantage inside the game itself.
All outputs are estimates. Game physics, maps and mechanics change without notice, and results depend on how you play. We do not promise any particular result, including landing first, surviving, or winning.
We may add, change or remove features at any time. Beta features are provided as-is and may be unfinished.
6. Pro Unlock subscriptions
When Pro Unlock launches, these terms apply to it:
- Free trial. With a free account you can try the map for a few routes and Zones for a few uses (the numbers are shown on the pricing page). After that, the map and Zones need Pro Unlock. Spot Lab and its gallery are part of Pro Unlock. We may change the size of the free trial.
- Price and renewal. Pro Unlock is billed monthly or yearly, as you choose, at the price shown at checkout (plus any applicable tax). It renews automatically at the end of each month or year, and your payment method is charged each time, until you cancel.
- Cancel any time, online. You can cancel online from your account page (Manage subscription), as easily as you signed up. Cancellation stops future charges; you keep Pro Unlock until the end of the month or year you have paid for.
- Refunds. Charges already made are not refunded, except where the law requires or where we choose to in a particular case. If you were charged in error, contact us within 30 days.
- Price changes. We will tell you before a price change takes effect on your subscription, and you can cancel before it does.
- Offers and promo codes. A promo code or launch offer applies as described when you use it, and ends as described.
- Failed payments. If a renewal payment fails, we and Stripe try again over a few days and you keep Pro Unlock meanwhile. If it still fails, the subscription ends.
- Payments. Payments are processed by Stripe under its own terms. We do not see or store your full card details.
- Your account. Pro Unlock belongs to your Droppin account. If you delete your account, your subscription is cancelled at once and the rest of the period is not refunded. If you are under 18, a parent or guardian must agree to the purchase.
7. Acceptable use
You agree not to:
- copy, scrape, resell, sublicense or redistribute the Service, its code, data, map work or outputs, or build a competing product from them;
- get around the sign-in, paywall or access controls, or share access with people who have not paid;
- reverse engineer the Service except where the law expressly allows it;
- use the Service for cheating, hacking or anything that breaks a game's rules or terms;
- interfere with the Service, its hosting or other users, or use bots to hit it at volume;
- use the Service in a way that breaks the law.
Spot Lab and the gallery. Names you give spots, doors and windows, and your username, must not be rude, hateful, sexual, threatening or misleading, and must not contain links, adverts or anyone's personal details (yours included). When you share a spot or publish it to the gallery, you let us and other players see it, copy it and use it in Droppin; you can take it out of the gallery at any time, but copies other players already made stay theirs. We may rename, hide or remove anything that breaks these rules or is reported, and stop an account from publishing, without notice.
8. Ownership
We own the Service and everything we made for it (the code, the physics model and its fitted constants, the route calculations, the deploy-ring data, the site design, the text, and the Droppin name and mark) and all rights in them. Using the Service gives you a personal, non-transferable, revocable right to use it for your own play; it does not give you any ownership. Feedback you send us may be used by us freely, without payment or credit.
9. Epic Games
Droppin is fan-made and is not an Epic website. Portions of the materials used are trademarks and/or copyrighted works of Epic Games, Inc. All rights reserved by Epic. This material is not official and is not endorsed by Epic. Fortnite and the Fortnite map belong to Epic; nothing in these Terms gives you any right in them.
10. Copyright complaints
If you believe something on the Service infringes your copyright, send a notice to legal@wherewedroppin.com with: your contact details; the work you say is infringed; where on the Service the material is; a statement that you believe in good faith the use is not authorised; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorised to act for them; and your physical or electronic signature. We respond to valid notices under the Digital Millennium Copyright Act, and may end access for repeat infringers.
11. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, accurate or current, or that any output will produce any result in any game.
12. Limitation of liability
To the fullest extent the law allows, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data, goodwill, in-game items, rankings or winnings, arising from or related to the Service. Our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim arose, or $50.
Some places do not allow some of these limits; where that is the case, they apply only as far as the law permits.
13. Indemnity
If you use the Service in breach of these Terms or the law and a claim is brought against us as a result, you agree to cover our reasonable losses and costs from that claim.
14. Disputes and arbitration
Talk to us first. Before filing any claim, email legal@wherewedroppin.com and give us 30 days to try to resolve it.
Individual arbitration. Any dispute that is not resolved will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either side may bring an individual claim in small-claims court. You and we each waive the right to a jury trial and to take part in a class action or class arbitration.
Opting out. You can opt out of this arbitration agreement by emailing us within 30 days of first accepting these Terms, saying you opt out.
Law and venue. These Terms are governed by the laws of the State of California and applicable US federal law. Any matter that is not arbitrated will be heard in the state or federal courts in Alameda County, California.
15. Ending access
You may stop using the Service at any time. We may suspend or end your access if you break these Terms, if required by law, or if we discontinue the Service. If we discontinue Pro, we will stop future charges. Sections 7 to 14 survive the end of your access.
16. Changes and general
We may update these Terms. If a change is material we will post it here with a new date, and for subscribers give notice before it applies. Continuing to use the Service after a change means you accept it. These Terms and the Privacy Policy are the whole agreement between you and us about the Service. If any part is unenforceable, the rest still applies. Our not enforcing a term is not a waiver of it. You may not transfer these Terms; we may transfer them with the business.
